Terms of Service
These Terms of Service ("Terms") are a legally binding agreement between you and WildHappyCo ("WildHappyCo," "we," "us," or "our") governing your access to and use of Woody, our website at https://woody.fit, our mobile application, and related services (collectively, the "Services").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Our Services
Woody provides fitness planning, workout logging, AI coaching, and voice coaching. The Services are for personal fitness and wellness use only.
Woody is not a medical device, healthcare provider, emergency service, or substitute for professional medical advice, diagnosis, or treatment.
2. Eligibility
You must be at least 13 years old to use Woody. If you are 13 to 17, you may use Woody only with consent and supervision from a parent or legal guardian.
You agree to provide accurate account information and keep it up to date.
3. Accounts
You may need an account to use some features. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You must not share your account, create accounts for others without permission, impersonate another person, or use the Services if we have suspended or banned you.
You can delete your account from inside the app. See our Account Deletion page for the current in-app deletion path.
4. Subscriptions and Apple In-App Purchase
Subscriptions for iOS digital features are purchased through Apple in-app purchase. Prices, billing periods, taxes, renewal terms, trial terms, and available plans are shown by Apple before purchase.
Subscriptions renew automatically unless canceled through your Apple account before the renewal date. You can manage or cancel subscriptions in Apple subscription settings. Account deletion does not directly control Apple's billing record or cancel an active Apple subscription.
Woody may offer a restore purchases control that asks Apple and Superwall to refresh your entitlement status. Refunds, billing disputes, and subscription management are handled by Apple according to Apple's policies.
Woody does not provide an external payment path for iOS digital features.
5. Fitness, Medical, and AI Disclaimers
Woody provides general fitness tracking, workout recommendations, and AI-powered guidance for informational and wellness purposes only.
Woody does not provide medical advice, diagnosis, treatment, emergency guidance, or medical care. Consult a physician, qualified trainer, or other appropriate professional before starting or changing an exercise program, especially if you have a medical condition, injury, disability, are pregnant, take medication, or have concerns about your health.
Exercise involves inherent risks. You are responsible for deciding whether any activity, workout, recommendation, or AI-generated suggestion is safe and appropriate for you. Stop exercising and seek medical help if you experience pain, dizziness, shortness of breath, chest pain, faintness, injury risk, or other concerning symptoms.
AI-generated responses may be incomplete, inaccurate, delayed, or unsuitable for your circumstances. Use your own judgment and do not rely on AI outputs for emergency, medical, or safety-critical decisions.
6. Voice Features
If you use voice features, you authorize Woody to process microphone audio during the session to transcribe or understand your request and provide coaching responses. Transcripts, commands, coach responses, workout actions, and related data may be stored as needed to provide, secure, support, and improve the Services.
Live voice sessions may require camera hardware permission because of the native WebRTC stack, but Woody does not provide video calling and does not record, store, or share photos or video.
7. User Content and Data Responsibility
You may provide workout data, notes, prompts, preferences, feedback, and other information through the Services ("User Content"). You are responsible for the accuracy and legality of your User Content and for using the Services in a safe way.
You retain ownership of your User Content. You grant us a limited license to use, host, process, reproduce, and display User Content as needed to provide, secure, support, and improve the Services.
If you send suggestions or feedback, we may use them without restriction or compensation to you.
8. Acceptable Use
You agree not to:
- Violate any law or regulation.
- Use the Services as a substitute for professional medical advice, diagnosis, treatment, or emergency care.
- Provide false health or fitness information that could compromise your safety.
- Bypass subscriptions, usage limits, safety systems, or account restrictions.
- Reverse engineer, decompile, scrape, crawl, copy, or extract source code, models, data, or content except as allowed by law.
- Use bots, automation, or scraping tools without our written permission.
- Interfere with or disrupt the Services, servers, networks, or security systems.
- Upload or transmit malware, harmful code, or abusive content.
- Submit harmful prompts, abuse AI systems, or attempt to generate illegal, unsafe, exploitative, or abusive output.
- Harass, abuse, threaten, or harm others.
- Share account credentials or transfer your account without permission.
- Use the Services for commercial purposes without our written permission.
9. Intellectual Property
We own or license the Services, including software, design, text, graphics, features, AI workflows, databases, content, trademarks, and other intellectual property.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial use.
You may not copy, reproduce, distribute, modify, sell, rent, sublicense, publicly display, or create derivative works from the Services except as expressly allowed by us in writing or by applicable law.
10. Privacy
Our Privacy Policy explains how we collect, use, and share personal information. By using the Services, you agree that we may process information as described in the Privacy Policy.

11. Third-Party Services
The Services rely on third-party services including Apple App Store, Superwall, Supabase, Daily, Pipecat, Deepgram, Cartesia, Google Gemini, OpenRouter, PostHog, and Sentry.
Third-party services are governed by their own terms and policies. We are not responsible for third-party services, content, policies, or decisions.
12. Service Changes and Availability
We may update, modify, suspend, or discontinue any part of the Services at any time. We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.
13. Termination
You may stop using the Services at any time and may delete your account in the app.
We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, misuse the Services, fail to pay applicable fees, or if required by law.
Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnity, dispute terms, and payment obligations.
14. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.
We do not warrant that workouts, recommendations, AI outputs, subscriptions, voice features, or app features will meet your needs, improve your fitness, prevent injury, or be safe or appropriate for your individual circumstances.
Nothing in these Terms limits rights that cannot be limited under applicable consumer protection law.
15. Limitation of Liability
To the fullest extent permitted by law, WildHappyCo and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, personal injury, or business interruption.
To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the amount you paid for the Services during the six months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
16. Indemnification
You agree to defend, indemnify, and hold harmless WildHappyCo from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from your use of the Services, your User Content, your violation of these Terms, your violation of law, or your infringement of another person's rights.
17. Changes to These Terms
We may update these Terms from time to time. The updated version will be indicated by an updated "Last updated" date. If we make material changes, we may notify you by email, in-app notice, or other appropriate means.
Your continued use of the Services after updated Terms take effect means you accept the updated Terms.
18. Governing Law and Disputes
These Terms are governed by the laws of India, without regard to conflict of law rules.
Before starting formal proceedings, you agree to contact us and attempt to resolve any dispute in good faith for 30 days.
If a dispute is not resolved informally, it will be resolved by arbitration in India, in English, before one arbitrator, unless applicable law gives you a non-waivable right to bring claims in another forum.
