Terms of Service
These Terms of Service ("Terms") are a legally binding agreement between you and WildHappyCo ("WildHappyCo," "we," "us," or "our") governing your access to and use of Woody, our website at https://woody.fit, our mobile application, and related services (collectively, the "Services").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Our Services
Woody is a fitness application that helps users log workouts, receive workout recommendations, use voice logging, and get AI-powered fitness guidance.
The Services are intended for personal fitness and wellness use only. Woody is not a medical device, healthcare provider, emergency service, or substitute for professional medical advice, diagnosis, or treatment.
2. Eligibility
You must be at least 18 years old to use the Services. By using the Services, you represent that you are at least 18 and have the legal capacity to agree to these Terms.
You agree to provide accurate account information and keep it up to date.
3. Accounts
You may need an account to use some features. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You must not share your account, create accounts for others without permission, impersonate another person, or use the Services if we have previously suspended or banned you.
You can delete your account from inside the app. Account deletion removes your account data from active systems immediately, except where retention is required for legal, security, fraud prevention, backup, or compliance reasons.
4. Subscriptions, Purchases, and Billing
At launch, subscriptions and purchases are offered through the Apple App Store and Google Play. Prices, billing periods, taxes, renewal terms, and available plans are shown at checkout in the applicable app store.
Subscriptions renew automatically unless canceled before the renewal date according to the rules of the Apple App Store or Google Play.
You can cancel your subscription through the Apple App Store or Google Play subscription settings used for your purchase. After cancellation, you may continue to access paid features until the end of the current billing period, unless the applicable app store states otherwise.
Refunds, chargebacks, billing disputes, and subscription management are handled by Apple or Google according to their policies. We do not control app store refund decisions.
If we later offer Stripe or another web checkout, additional payment terms may apply and we will update these Terms as needed.
5. Fitness, Health, and AI Guidance
Woody provides general fitness tracking, workout recommendations, voice logging, and AI-powered guidance for informational and wellness purposes only.
Woody does not provide medical advice, diagnosis, treatment, emergency guidance, or safety-critical advice. You should consult a physician, qualified trainer, or other appropriate professional before starting or changing an exercise program, especially if you have a medical condition, injury, disability, are pregnant, take medication, or have concerns about your health.
Exercise involves inherent risks. You are responsible for deciding whether any activity, workout, recommendation, or AI-generated suggestion is safe and appropriate for you. Stop exercising and seek medical help if you experience pain, dizziness, shortness of breath, chest pain, faintness, or other concerning symptoms.
AI-generated suggestions may be incomplete, inaccurate, or unsuitable for your circumstances. Do not rely on AI outputs for emergency, medical, or safety-critical decisions.
6. Voice Features
If you use voice features, you authorize Woody to process your audio input to transcribe or understand your request. Voice audio is deleted after processing. Resulting text, workout logs, actions, and related app data may be stored as needed to provide the Services.
7. HealthKit, Google Fit, and Device Permissions
Woody may offer integrations with Apple HealthKit, Google Fit, Bluetooth, microphone, notifications, or other device features. You control these permissions through your device or platform settings. Some features may not work if permissions are disabled.
8. Acceptable Use
You agree not to:
- Violate any law or regulation.
- Provide false health, fitness, or biometric information that could compromise your safety.
- Use the Services as a substitute for professional medical advice, diagnosis, or treatment.
- Rely on AI-generated guidance for emergency, medical, or safety-critical decisions.
- Bypass subscriptions, usage limits, safety systems, or account restrictions.
- Reverse engineer, decompile, scrape, or extract source code or models except as allowed by law.
- Interfere with or disrupt the Services, servers, networks, or security systems.
- Use bots, automation, or scraping tools without our written permission.
- Upload or transmit malware, harmful code, or abusive content.
- Harass, abuse, threaten, or harm others.
- Share account credentials or transfer your account without permission.
- Use the Services for commercial purposes without our written permission.
9. Intellectual Property
We own or license the Services, including software, design, text, graphics, features, AI workflows, databases, content, trademarks, and other intellectual property.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial use.
You may not copy, reproduce, distribute, modify, sell, rent, sublicense, publicly display, or create derivative works from the Services except as expressly allowed by us in writing or by applicable law.
10. User Content and Feedback
You may provide workout data, notes, prompts, preferences, feedback, or other information through the Services ("User Content"). You retain ownership of your User Content.
You grant us a limited license to use, host, process, reproduce, and display User Content as needed to provide, secure, support, and improve the Services.
If you send suggestions or feedback, we may use them without restriction or compensation to you.
11. Privacy
Our Privacy Policy explains how we collect, use, and share personal information. By using the Services, you agree that we may process information as described in the Privacy Policy.

12. Third-Party Services
The Services may rely on or link to third-party services, including Apple App Store, Google Play, Supabase, Sentry, PostHog, Expo, Google Cloud AI, Groq, OpenAI, Apple HealthKit, and Google Fit.
Third-party services are governed by their own terms and policies. We are not responsible for third-party services, content, policies, or decisions.
13. Service Changes and Availability
We may update, modify, suspend, or discontinue any part of the Services at any time. We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.
14. Termination
You may stop using the Services at any time and may delete your account in the app.
We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, misuse the Services, fail to pay applicable fees, or if required by law.
Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnity, dispute terms, and payment obligations.
15. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.
We do not warrant that workouts, recommendations, AI outputs, or app features will meet your needs, improve your fitness, prevent injury, or be safe or appropriate for your individual circumstances.
Nothing in these Terms limits rights that cannot be limited under applicable consumer protection law.
16. Limitation of Liability
To the fullest extent permitted by law, WildHappyCo and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, personal injury, or business interruption.
To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the amount you paid to us for the Services during the six months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
17. Indemnification
You agree to defend, indemnify, and hold harmless WildHappyCo from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from your use of the Services, your User Content, your violation of these Terms, your violation of law, or your infringement of another person's rights.
18. Changes to These Terms
We may update these Terms from time to time. For material changes, we may provide notice at least 7 days before the changes take effect, such as through email, in-app notice, or website notice. Security updates, bug fixes, and changes required by law may be effective immediately.
Your continued use of the Services after updated Terms take effect means you accept the updated Terms.
19. Governing Law and Disputes
These Terms are governed by the laws of India, without regard to conflict of law rules.
Before starting formal proceedings, you agree to contact us and attempt to resolve any dispute in good faith for 30 days.
If a dispute is not resolved informally, it will be resolved by arbitration in India, in English, before one arbitrator, unless applicable law gives you a non-waivable right to bring claims in another forum.
